1. Eligibility
You must be at least 21 years of age and legally capable of entering into a binding contract to use the Site and place an order. By submitting an order, you represent and warrant that you meet this age and consent requirement.
2. Price Lock Policy
The price displayed at the time your order is placed is the price you will pay, provided that your payment is postmarked or your ACH or wire transfer is initiated within one business day of placing the order.
If payment is not initiated within one business day, the order will be requoted based on the current spot ask price at the time payment is made. This applies whether the market has risen or fallen during the delay.
We reserve the right to cancel or correct any order affected by a typographical, pricing, or technical error, including errors caused by a delay or malfunction in spot price data.
3. Accepted Payment Methods
We currently accept the following payment methods:
- Personal check mailed to our business address, payable to Herb's Coins
- ACH bank transfer
- Bank wire transfer
We do not currently accept cashier's checks, money orders, credit cards, or debit cards.
Orders paid by personal check will not ship until the check has fully cleared our bank, which may take up to ten business days from receipt. Orders paid by ACH or wire transfer generally ship sooner, once funds are confirmed received.
Payment instructions are emailed after you place your order. We will never send you updated or changed wire instructions mid-transaction. If you receive a message that appears to change our banking details, do not send funds. Call us at (941) 629-5777 to verify. If we do not answer, leave a message and we will return your call.
4. Order Reservation and Inventory Hold
Placing an order reserves the selected items for up to eight calendar days.
If payment is not received or initiated within this period, the order will be automatically cancelled, and the reserved inventory will be returned to available stock.
5. Sales Tax
Sales tax is calculated at checkout based on the customer's shipping address and applicable state laws.
Certain precious-metal purchases may qualify for a sales-tax exemption depending on the customer's state and the value or type of products purchased. Any applicable sales tax will be displayed during checkout and included in the total payment amount.
We collect and remit sales tax only in states where we are registered to do so. The absence of sales tax on your order does not relieve you of any use tax you may owe directly to your own state.
6. Shipping, Risk of Loss, and Insurance
All shipped orders are sent fully insured through USPS Registered Mail and require an adult signature upon delivery. For purposes of these Terms, an adult is a person 21 years of age or older.
Please allow approximately one to two weeks for delivery after payment has cleared.
Shipping and handling is calculated automatically at checkout based on the order subtotal:
- Up to $500.00: $35.00
- $500.01 to $2,000.00: $50.00
- $2,000.01 to $5,000.00: $75.00
- $5,000.01 to $15,000.00: $125.00
- $15,000.01 to $25,000.00: $175.00
These fees cover USPS Registered Mail postage, declared value insurance, and secure packaging. They are set to cover our actual shipping costs.
Shipping availability varies by product and destination. Checkout will show whether shipping is available to your address. We do not ship to U.S. territories or international addresses.
Risk of loss passes to you once the carrier confirms delivery to the address provided on your order. We are not responsible for loss, theft, or damage occurring after confirmed delivery.
If you instruct the carrier to leave a package without obtaining a signature, request that someone other than the named recipient sign for the package, or direct delivery to a third-party mailbox or locker location, this voids our insurance coverage on that shipment and you assume all risk associated with that instruction.
Packages are shipped discreetly, with no indication of contents on the exterior.
7. In-Store Pickup
In-store pickup is available at no charge at our Port Charlotte location. Orders are typically ready within 24 hours.
Please bring a photo ID matching the name on your order.
8. Order Limits and New Customer Orders
Shipped orders are currently capped at $25,000 per transaction. Orders above this amount cannot be completed online for shipping.
Orders over $10,000 from new customers may require a brief verification call before processing. We will contact you within one business day of receiving your order. Herb's Coins reserves the right to contact customers by phone or email to confirm order details before shipment.
For orders exceeding $25,000 please contact us directly. We are happy to accommodate larger purchases on a case by case basis.

9. Inspection and Claims
Please inspect your order immediately upon receipt. Any claim regarding an incorrect item, a missing item, or a product discrepancy must be submitted to us in writing within five business days of confirmed delivery.
Claims submitted after this period cannot be honored.
10. Returns and Disputes
All sales are final, except in the case of a verified discrepancy reported within the window described in Section 9.
Because precious-metal prices fluctuate, we cannot accept returns, cancellations, or refund requests based on changes in market prices after an order has been confirmed.

11. Limitation of Liability
You will, to the fullest extent permitted by law, limit our liability for any claim arising from a transaction under these Terms - whether based on contract, negligence, or any other legal theory - to the purchase price of the specific product(s) involved in that transaction.
You will not hold us liable for any indirect, incidental, or consequential damages, including but not limited to loss of investment value or market opportunity.
12. Indemnification
You will indemnify and hold harmless Herb's Coins, its owners, and employees from any claims, damages, or expenses (including reasonable attorney's fees) arising from your breach of these Terms or your misuse of the Site.
13. No Investment Advice
Information provided on this site is for general informational purposes only and does not constitute financial, investment, or legal advice. You are solely responsible for evaluating the suitability of any purchase for your own circumstances.
14. Governing Law and Jurisdiction
All transactions with Herb's Coins are deemed to take place in Port Charlotte, Florida.
Any dispute arising from a transaction shall be governed by the applicable laws of the State of Florida and handled within the appropriate courts serving Charlotte County, Florida.
By placing an order, the customer acknowledges and agrees that the transaction and any resulting contract are entered into in Florida.
15. Changes to These Terms
We may update these Terms at any time by posting a revised version on this site. Changes apply to orders placed after the updated Terms are posted.
16. Entire Agreement
This Agreement is the entire agreement between the Parties with respect to the subject matter and supersedes any prior agreement or communications between the Parties hereto, whether written, oral, or electronic. No course of prior dealings between the Parties and no usage of the trade shall be relevant to supplement or explain any term used in this Agreement. Acceptance or acquiescence in a course of performance rendered under this Agreement shall not be relevant to determine the meaning of this Agreement even though the accepting or acquiescing party has knowledge of the nature of the performance and opportunity for objection.
17. Headings; Construction
The headings and captions appearing in this Agreement have been inserted for the purposes of convenience and ready reference, and do not purport to and shall not be deemed to define, limit or extend the scope or intent of the provisions to which they appertain.
18. Severability
If any provision or portion of this Agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect.
19. Lack of Waiver
The failure of either party to require strict performance by the other shall not constitute a waiver of any of such party's rights pursuant to this Agreement, or to thereafter require strict performance by such other party.
